False statements or representation: Debt collection
I am filing a complaint regarding a debt collection account that has been reported under my name. I previously requested validation of this alleged debt pursuant to my rights under the Fair Debt Collection Practices Act ( FDCPA ). The collection agency has failed to provide sufficient documentation to verify that I am legally responsible for this debt. The information provided by the collector does not constitute proper validation. To date, they have not provided : A copy of the original signed contract or agreement bearing my signature. Documentation showing I incurred the debt. A complete payment history and accounting of the alleged balance. Documentation demonstrating the collector has legal authority to collect the debt. Evidence that the debt was lawfully assigned or transferred to the collection agency. Verification from the original creditor supporting the amount being claimed. Instead of providing competent evidence, the collector continues to report the account and/or attempt collection without properly validating the debt. I am requesting that the CFPB investigate this matter and require the collection agency to provide adequate verification of the debt. If they can not provide the required documentation, I request that all collection activity cease and that any reporting of this account to consumer reporting agencies be deleted immediately. I also request that the collection agency comply with all provisions of the FDCPA and the Fair Credit Reporting Act ( FCRA ). Reporting an unverified debt may constitute inaccurate credit reporting and cause significant harm to my credit profile. I respectfully request a written response addressing this complaint and explaining the basis upon which the collector claims this debt has been verified. Thank you for your attention to this matter.
