Attempts to collect debt not owed: Debt collection
Subject : CFPB Complaint Against Jefferson Capital Systems , LLC I am filing this complaint against Jefferson Capital Systems , LLC for reporting inaccurate, incomplete, and/or unverified information on my consumer credit reports and for failing to comply with their obligations under federal consumer protection laws. I have disputed this account and requested validation of the alleged debt. Despite my requests, Jefferson Capital has continued to report the account to the consumer reporting agencies without providing sufficient evidence that the debt is accurate, valid, and legally enforceable. I have not received a copy of the original signed agreement, complete account statements, documentation showing the chain of assignment, or proof that Jefferson Capital has the legal right to collect and report this alleged debt. Their actions appear to violate several provisions of federal law, including but not limited to : * * Fair Credit Reporting Act ( FCRA ) * * * * * 15 U.S.C. 1681s-2 ( a ) * * Prohibits furnishers from reporting information they know or have reasonable cause to believe is inaccurate. * * * 15 U.S.C. 1681s-2 ( b ) * * Requires furnishers to conduct a reasonable investigation upon receiving notice of a dispute from a consumer reporting agency. * * * 15 U.S.C. 1681e ( b ) * * Requires maximum possible accuracy in consumer reporting. * * * 15 U.S.C. 1681i * * Requires disputed information to be properly investigated and corrected or deleted if it can not be verified. * * Fair Debt Collection Practices Act ( FDCPA ) * * * * * 15 U.S.C. 1692e * * Prohibits the use of false, deceptive, or misleading representations in connection with the collection of a debt. * * * 15 U.S.C. 1692e ( 8 ) * * Requires debt collectors to communicate that a debt is disputed when reporting it to consumer reporting agencies. * * * 15 U.S.C. 1692f * * Prohibits unfair or unconscionable collection practices. * * * 15 U.S.C. 1692g * * Requires debt collectors to provide proper validation of an alleged debt upon request. If Jefferson Capital can not produce competent evidence demonstrating that the account is accurate and legally enforceable, they should not be reporting the account to any consumer reporting agency. I am requesting that Jefferson Capital Systems immediately : 1. Conduct a thorough and reasonable investigation of this disputed account. 2. Provide complete validation of the alleged debt, including all supporting documentation. 3. Provide proof of ownership and the complete chain of assignment of the debt. 4. Correct any inaccurate information being reported. 5. Delete the account from all consumer reporting agencies if it can not be fully verified. 6. Provide written confirmation of the results of their investigation. I respectfully request that the Consumer Financial Protection Bureau investigate this matter and require Jefferson Capital Systems to comply with all applicable provisions of the FCRA, FDCPA, and other federal consumer protection laws.
