Issue : Debt Collection I am filing this complaint regarding Fair Collections & Outsourcings ( FCO ) attempt to collect an alleged $91.00 electric utility debt that I was never made aware of until more than one year after I had vacated my apartment. I moved out of the apartment approximately three years ago. At the time I vacated the property, I was never provided with a final utility bill, notice of an outstanding balance, or any communication indicating that I owed money to the utility provider. Had I been notified of a legitimate balance, I would have promptly paid a $91.00 obligation and avoided any collection activity. Instead, my first notice of this alleged debt came more than a year after I had already moved out, when I was informed that the account had been placed with a third-party debt collector. As a result, I was deprived of a reasonable opportunity to review, verify, or resolve the alleged balance directly with the original creditor before it was referred to collections. To date, I have not been provided with documentation demonstrating that I was properly billed for this alleged balance before the account was referred for collection. I have not received the original utility bill, an itemized account statement, or documentation showing when and how the original creditor attempted to notify me of the alleged debt. Consumers should receive timely notice of any outstanding balance and be given a fair opportunity to resolve it before being subjected to third-party collection efforts. In this case, that did not occur. The lack of timely notice prevented me from addressing the matter when it could have been resolved quickly and without unnecessary collection activity. Given that I was not informed of this alleged debt until more than a year after vacating the property, I believe it is unfair and unreasonable to pursue collection under these circumstances. I respectfully request that the CFPB review this matter and require Fair Collections & Outsourcing to provide an appropriate resolution consistent with applicable consumer protection laws.

This debt collector has done unjustifiable practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon and I didn't sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. they didn't follow the proper 5-step validation procedure. According to the FDCPA, Im entitled to compensation for these violations and clearly, they violated my rights and abused my privileges. I demand this account be taken off immediately.

I am filing this complaint because Fair Collections & Out continues to report and collect a debt that I have repeatedly asked them to explain and validate. The account is being reported for $2900.00. After I disputed the account, I requested documents showing how this balance was calculated. I specifically asked for an itemized statement, account ledger, move-out statement, payment history, and any records supporting the amount they claim I owe. The only documents I received were a copy of the lease agreement and a statement showing the balance. I was not provided with any breakdown of charges, any accounting of the balance, or any documents showing how they arrived at $2900.00. I moved out when my lease ended. I never received a final accounting, move-out statement, or any explanation from the apartment management regarding an alleged balance. The first time I became aware of this debt was when it was sent to collections. What concerns me most is that the company continues to verify the account as accurate with the credit bureaus even though they have never provided documentation showing how the balance was calculated. If the debt is valid, I am simply asking for the records that support it. If they verified the account with the credit bureaus, they should be able to provide the documentation they relied upon when doing so.

Pursuant to 15 U.S.C. 1681s-2 ( b ), I dispute the accuracy and completeness of the collections being reported on my credit file. Upon receiving notice of this dispute, the furnisher is required to conduct a reasonable investigation, review all relevant information, and report accurate results to the consumer reporting agencies.

It has been frustrating and emotionally draining to deal with an account that I do not believe has been properly validated. I demand this account be taken off immediately.
